Creator Terms of Service

This Terms of Service Agreement ("Agreement") governs your use of Oshi Konnect as a Creator. By accessing or using Oshi Konnect's Creator platform, you acknowledge and agree to the terms outlined below.

1. Creator Account and Eligibility

To use Oshi Konnect as a Creator, you must:

  • Be at least 18 years of age;
  • Have the legal capacity to enter into this Agreement;
  • Provide accurate and complete registration information;
  • Maintain the security of your account credentials.

2. License to Use Platform Content

Unless otherwise specified, all content available on Oshi Konnect remains the exclusive property of Oshi Konnect or its licensors. Subject to your continued compliance with this Agreement, Oshi Konnect grants you a limited, worldwide, non-exclusive, non-transferable, revocable license to:

  • Use Oshi Konnect for personal and commercial content creation purposes;
  • Create content and upload media that complies with this Agreement;
  • Display your content on your Oshi Konnect profile, social media accounts, and other digital platforms;
  • Use the platform's tools, streaming functions, and communication features;
  • Receive payments and tips from fans through the platform.

This license does not grant ownership of Oshi Konnect's branding, trademarks, platform technology, proprietary features, or any other intellectual property.

3. Commercial Use of Content

As a Creator, you may:

  • Commercialize your own original content created and uploaded to the platform;
  • Set up subscription tiers and accept tips from fans;
  • Receive earnings through Stripe Connect integration.

Use of Oshi Konnect-owned materials for commercial purposes requires express written consent.

4. Creator Earnings and Payments

  • Oshi Konnect facilitates payments through Stripe Connect;
  • You are responsible for providing accurate payment information;
  • Platform fees and Stripe processing fees apply to all transactions;
  • You are solely responsible for reporting and paying applicable taxes on your earnings;
  • Oshi Konnect may withhold payments pending verification or investigation of policy violations.

5. Content Guidelines

As a Creator, you agree not to:

  • Upload content that infringes on intellectual property rights;
  • Post illegal, hateful, defamatory, or harmful content;
  • Upload sexually explicit or adult content unless expressly permitted;
  • Harass, bully, or threaten other users;
  • Misrepresent your identity or affiliation;
  • Use the platform for fraudulent activities;
  • Reverse-engineer or interfere with the platform.

These restrictions survive account termination.

6. Ownership and Intellectual Property

  • Oshi Konnect retains ownership of its technology, trademarks, branding, interface, features, algorithms, and proprietary systems;
  • You retain ownership of your original uploaded content;
  • By uploading content, you grant Oshi Konnect a worldwide, non-exclusive, royalty-free license to display and use your publicly posted content for promotional or platform purposes;
  • This license may survive deletion when content has already been used or must be legally retained.

7. Disclaimer of Warranties

Oshi Konnect does not guarantee:

  • Accuracy of user-generated content;
  • Uninterrupted platform access;
  • Safety of external links or third-party services;
  • Specific revenue or subscriber growth.

Creators assume all risks associated with platform use.

8. Limitations of Liability

Oshi Konnect is not liable for:

  • Lost passwords, compromised accounts, or user errors;
  • Technical failures or interrupted service;
  • Harms arising from user interactions;
  • Loss of content or account data;
  • Lost earnings or missed opportunities.

All platform use is at your own risk.

9. Account Termination

Oshi Konnect may suspend or terminate your Creator account for:

  • Violation of these Terms of Service;
  • Fraudulent or illegal activity;
  • Extended inactivity;
  • At our sole discretion with reasonable notice.

Upon termination, you will receive any outstanding earnings minus applicable fees.

10. Dispute Resolution

Disputes shall be resolved exclusively through binding arbitration in Orange County, Florida.
The prevailing party is entitled to attorney's fees and costs.

11. Third-Party Product and Giveaway Disclaimer

Oshi Konnect may run giveaways involving third-party products. Oshi Konnect:

  • Is not affiliated with the manufacturers or brands;
  • Does not guarantee product performance beyond manufacturer warranties;
  • Is not responsible for shipping delays, damage, or loss;
  • Does not insure against injuries or incidents related to trips or experiences.

Brand names are used descriptively only.

12. Modifications to Terms

Oshi Konnect reserves the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.
